RRkids offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

Please read the following Terms and Conditions that are detailed below before you visiting our site and/ or purchasing something from us as they constitute the basis of the sale agreement between you and RRkids Pty Ltd (ABN 69 649 376 741).These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services.

Any new features or tools which are added to the current store shall also be subject to the Terms of Service. You can review the most current version of the Terms and Conditions at any time on this page. 

Please note that from time to time, these Terms and Conditions may change. We, therefore, recommend that you review these terms and conditions on a regular basis to identify any changes that may affect you.

Online Store Terms

By agreeing to these Terms and Conditions, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to the technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Products or Services (if applicable)

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

Pricing & GST

Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.

In addition to the price for the Goods, you will also need to pay the advertised delivery charge (if any) (“Delivery Charge”). Any Delivery Charge will appear in your shopping cart. RRkids only delivers to certain addresses within Australia. You may also need to pay any additional delivery charges which are not shown in your shopping cart but which we incur because you live in an area where light aircraft or barge transport is required, or to which our couriers do not provide door-to-door service (“Additional Delivery Charge”). These include, without limitation, Christmas Island, Norfolk Island, and remote parts of Queensland and the Northern Territory. Such charges may apply even where the item is shown on the Website as having “free delivery”, “free freight” or something similar. 

If you live in an area to which an Additional Delivery Charge will apply, we will contact you before accepting your Order. If, within the timescale specified, you do not agree to accept the Additional Delivery Charge, RRkids will cancel your Order. RRkids will not take payment for your Order until you have confirmed your acceptance of the Additional Delivery Charge. 

By placing an Order you agree to pay the price for the Goods, any Delivery Charge and any Additional Delivery Charge.

All prices and Delivery Charges and Additional Delivery Charges quoted are in Australian dollars and are inclusive of GST. The current rate of GST is 10%. This rate may change in the future and will be based on Australian legislation. The prices indicated for products exclude freight and handling.

Accuracy Of Billing And Account Information

RRkids reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

 You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

You agree that your comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary rights. You further agree that your comments will not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third party.

Risk & Title

Risk and title in Goods pass to you on the date and time of delivery of the Goods to the delivery address provided in your Order.

Availability of Products

As RRkids is dependent upon its Suppliers to provide stocks, therefore, we cannot guarantee availability at all times. We will use our best endeavours to supply you with the product ordered. On occasion, however, goods that are displayed on our website may not be available. If this occurs, we will contact you and offer you a part dispatch for the balance of your order that is available or issue you with a refund for that part of the order that cannot be supplied.

RRkids reserves the right to withdraw or suspend from sale any Goods displayed on the Website, either temporarily or permanently, at any time without notice to you. Except to the extent otherwise required by law (including, without limitation, the Australian Consumer Law), RRkids will not be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of the unavailability of any Goods at any time, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

Shipping and Delivery

Goods will only be delivered to addresses within Australia. However, there are certain remote areas in Australia that we do not deliver to: 

• Christmas Island
• Norfolk Island
• areas in postcodes 0880 and 0881 (Northern Territory) and 
• areas in postcode 4875 (Queensland)

Shipping & Handling costs are influenced by the size and weight of the product and location, exact shipping & handling costs are calculated in the shopping cart and will be added to the order total before checkout. (Please refer back to “Pricing & GST” sections for Delivery charges & Additional Delivery charges).

To ensure the security of your Goods, RRkids will not deliver to a PO Box, locked bag or parcel locker.

If you require Goods that you have ordered to be re-directed to an address which is not the original Order address RRkids may charge you a reasonable fee for doing this.

Once your order has been processed, We will do our best to dispatch your Goods within 24 to 48 hours. However, in some cases, it may take longer. Refer to the shipping & delivery information under the “Shipping & Return Policy” Pages.

Delay In Availability Or Delivery Of Goods

You agree and acknowledge that: 

• RRkids does not guarantee the delivery or availability of Goods within the timeframes stated in the “Shipping & Delivery” section.
• events outside RRkids’ control may cause delays, or in some circumstances, prevent your Goods from being delivered;
• delays are particularly likely to occur around Christmas, Easter and public holidays; and
• except to the extent expressly set out in these Terms and Conditions or otherwise required by law (including, without limitation, the Australian Consumer Law), neither RRkids nor any of its agents will be liable to you, or any other person, for any loss, damage, cost or expense suffered as a direct or indirect result of any delay in delivery of the Goods to you or delay in the availability of Goods for pick up in-store, whether in contract, negligence or any other tort, equity, restitution, strict liability, under statute or otherwise at all.

Incorrect Goods Supplied 

If we supply you with an incorrect product, we will supply you with the correct product once the incorrect product has been returned. In the event of a wrong product being supplied, you must contact us via email at [email protected] within 48 hours of receiving your goods. The freight cost incurred will be paid by RRkids.

Faulty Products

Our Company takes pride in supplying quality products. Our goods come with guarantees which cannot be excluded under the Australian Consumer Law (Statutory warranties). You are entitled to a replacement or a refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Statutory warranties: If, within a reasonable period of time after your receipt of the goods, those goods are found to be faulty as a result of a manufacturing defect, then you must contact us at the address referred to at the end of these Terms and let us know what the problem is. We will supply you with an identical product within 30 days after the faulty product has been returned to us by you providing you do not make any further use of the faulty product after you discover that it is faulty. You must, when returning the faulty product, clearly state in writing in BLOCK CAPITALS, the address to which the replacement product is to be sent.

Returns/Change of Mind/Exchanges/Refunds

Goods may be exchanged or refunded within 14 days of the purchase date. You should check your Goods as soon as they are delivered to you in order to ensure that your order is correct and not damaged or faulty.

If you have a problem with any Goods or otherwise wish to return them, please refer to RRkids “Shipping & Return Policy” which forms part of these Terms and Conditions.

Please note that you are not entitled to any refund or exchange just because any packaging is damaged in transit. The packaging exists to protect the Goods themselves.

Refunds

In the event of products not being available for supply to you after your order has been placed with us we will issue you a refund for either part of the order or for the entire order.

All refunds will be made the same way as the original payment method was made in favour of the person or entity on the original transaction.

Cancellation of Orders

Provided your items have not been shipped, collected or delivered, you can cancel an order, however, a 20% cancellation fee will apply to the total amount.

Use of Goods

It is essential that all products purchased from us are only used in the manner that they are intended to be used. It is essential that the products purchased from us are not modified in any way whatsoever from the condition they were supplied in. We accept no responsibility whatsoever if products are modified in any manner from the condition that they were supplied. If you are at any time unsure about a products intended use, it is essential that you contact us by e-mail immediately for advice in this regard.

Errors, Inaccuracies And Omissions

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

Indemnification

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall RRkids, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

As a condition of purchase from RRkids we reserve the right to email you our newsletters and information that we may consider may be of interest to you. All our newsletters and communications of a similar nature will have a clear link to unsubscribe.

Authority to Purchase from RRkids

By accepting our sales terms and conditions, you are acknowledging that you have the authority to enter into a commercial transaction with RRkids. If you are under 18 years of age, you cannot enter into a transaction with RRkids. Instead, you should seek the assistance of your parents or guardians. Commercial employees, purchasing on behalf of their company or business must have the appropriate company authority to enter into a transaction on the company’s behalf.
